AGREEMENT BETWEEN USER AND Bookmypet

A. Acceptance of Terms

"BOOKMYPET FZE" maintains the https://www.bookmypet.com/ Website ("Site"). The terms and conditions set forth below ("Terms of Use") and the Privacy Policy constitute a legally-binding agreement between Bookmypet, a Company incorporated in United Arab Emirates ("Bookmypet"), and you.

1. Modifications To Terms Of Use And/or Privacy Policy

Bookmypet reserves the right to amend the Terms & conditions, and any other documents incorporated by reference herein, at any time, and Bookmypet will post notice of the changes and the amended Terms of Use at the domain of https://www.bookmypet.com/terms, and/or may communicate the amendments through any method of written contact that Bookmypet has established with you.

2. Privacy Policy

Bookmypet has established a Privacy Policy that explains to users how their information is collected and used. The Privacy Policy is located at: https://www.bookmypet.com/privacy.

3. Access and Use of the Platform

The Platform is currently made available to you for your personal, non-commercial use, free of charge. We do not guarantee that access to the Platform, or any content on it, will always be available or be uninterrupted.

4. We do not own Services

The Platform is a Pet services search engine that provides users with comparisons for different offers for Pet boarding services, Pet Day care services, Grooming services, Veterinary services, and any other related services the platform decides to incorporate in the future as well. Bookmypet does not provide, own or control any of the services and products that you can access through our Platform (the "Pet Service Products").

B. Membership and Accessibility

1. License To Access

Bookmypet hereby grants you a non-exclusive, revocable license to use the Platform as set forth in the Terms of Use.

2. Membership Eligibility Criteria

Use of the Platform is available only to individuals who are at least 18 years old and can form legally binding contracts under applicable law.

3. Additional Policies

Your access to, use of, and participation in the Platform is subject to the Terms of Use and all applicable Bookmypet regulations, guidelines and additional policies that Bookmypet may set forth from time to time.

C. Member Conduct

1. Prohibitions On Submitted Content

You shall not upload, post, transmit, transfer, disseminate, distribute, or facilitate distribution of any content, including text, images, video, sound, data, information, or software, to any part of the Platform that:

Misrepresents the source of anything you post
Invades anyone's privacy
Contains falsehoods or misrepresentations
Is pornographic, harassing, hateful, illegal, obscene, defamatory
Contains or promotes an illegal or unauthorized copy of another person's copyrighted work

2. Prohibitions On Sending Messages

You will not send messages to other users containing:

Offers to make national or international money transfers for amounts exceeding the asking price of a service
Unsolicited advertising or marketing of a service not offered on the Platform
Personal contact information including but not limited to phone numbers, social media addresses and emails

D. Rules for Service Providers

1. Profiles And Offers Must Not Be Fraudulent

Service Providers shall not misrepresent the location at which they will provide a Service or include brand names or other inappropriate keywords in their Profile.

2. Profiles And Offers Cannot Use Techniques To Avoid Or Circumvent Bookmypet Fees

Service Providers shall not offer a catalog or a link to a third-party website from which Service Users may obtain the Service directly.

E. Rules for Service Users

1. Service Users Shall Not Take Any Of The Following Actions:

Commit or book to purchasing or using a Service without paying
Sign up for, negotiate a price for, use, or otherwise solicit a Service with no intention of following through

F. Use of Submitted Content

1. No Confidentiality

The Platform does not guarantee any confidentiality with respect to any Submitted Content.

G. Mandatory Third Party Verification Service

Bookmypet uses a variety of tools in an effort to make our Platform as safe as possible for Service Providers and Service Users. Among these tools could be background checks and identification verifications with national databases.

H. Copyright Infringement Take Down Procedure

If you believe that your work has been copied and posted on the Platform in a way that constitutes copyright infringement, please send the required information to [email protected].

I. Modifications to or Termination of Platform

1. Modification Or Cessation Of Platform

Bookmypet reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Platform (or any part thereof) with or without notice and in its sole discretion.

J. Intellectual Property Rights

1. Bookmypet Owns Or Holds The Licenses To All Data And Marks On The Platform

The content on the Platform (exclusive of all Submitted Content), including without limitation, the text, software, scripts, graphics, photos, sounds, music, videos, interactive features and the like ("Data") and the trademarks, service marks and logos contained therein ("Marks"), are owned by Bookmypet.

K. Bookmypet Fees

1. Fees Incurred By Service Providers

Joining Bookmypet, posting Services, prices and your company profile including viewing posted Services is free. Bookmypet reserves the right at its sole discretion to charge fees to Service Providers for other services that Bookmypet may provide.

2. Fees Incurred By Service Users

Joining Bookmypet, viewing posted Services, and requesting & booking for posted Services is free. Bookmypet currently charges Service Users no fees for transactions completed on the Platform between Service Users and Services Providers.

3. Refund Policy

All amounts paid through Bookmypet platform(s) will be non-refundable except as provided herein:

A cancellation request is made in accordance to the Cancellation Policy
Customer waiting time exceeds 45 minutes from the time of confirmed appointment
The service provider is unable or unwilling to fulfill the services that were booked and paid for online
If and when your pet fails the required assessment mentioned on the service providers profile

L. E-Commerce and Pet Product Purchases

1. Overview

Bookmypet offers users access to pet products through a dedicated e-commerce platform within the App and Website. These products may be sold and fulfilled either by Bookmypet directly or by third-party merchants listed on the platform.

2. Role of Bookmypet

Unless explicitly stated otherwise, Bookmypet acts solely as an intermediary between the customer and the third-party seller.

3. Orders & Payment

All orders are subject to availability and acceptance. Prices listed include VAT unless stated otherwise. Full payment is required at checkout through the available payment methods.

4. Shipping & Delivery

Shipping timelines are indicative and may vary depending on the product and location. Delivery services are provided by third-party logistics partners.

5. Returns & Refunds

Products may be eligible for return or exchange within 3 days of delivery, provided they are unopened, unused, and in original condition with all packaging intact.

6. Product Descriptions & Liability

We strive to provide accurate product information; however, Bookmypet does not warrant that descriptions or other content are error-free.

7. User Responsibilities

Users are responsible for reviewing ingredients, materials, or suitability of products for their pets.

8. Data Sharing with Merchants

To process orders and ensure delivery, Bookmypet may share your contact and delivery information with the respective merchant and logistics partner.
